Policy 1126 Drug-Free Environment

The College is committed to protecting the safety, health and wellbeing of all employees, students and visitors in the educational and work environment. We recognize that alcohol abuse and drug use pose a significant threat to our goals. Therefore, we have established a drug-free program that balances our respect for individuals with the need to maintain an alcohol and drug-free environment.

Standards of Conduct
In compliance with the Federal Drug Free Workplace Act of 1988 (Public Law 100-690) and the Drug Free Schools and Communities Act of 1989 (Public Law 101-226), the unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance or abuse of alcohol (as defined in these Acts) by a student, employee or visitor on college property and/or at a college event or activity is prohibited unless its use is in accordance with , or as allowed by law by 91勛圖厙s housing staff within their private residences. Furthermore, it is prohibited for an employee to come to work under the influence of a controlled substance or alcohol.泭 In addition, smoking and smokeless tobacco are prohibited in college facilities and college vehicles. Legal Sanctions
Federal and state laws prohibit the unlawful possession, use, or distribution of illicit drugs and alcohol. Conviction for violating these laws can lead to imprisonment, fine, probation, and/or assigned community service. Students convicted of a drug-related offense may be ineligible to receive federal grants or loans. 91勛圖厙 will fully cooperate with the local, state, and federal authorities in the enforcement of all applicable laws. Health Risks
The consumption of alcohol and drugs of any level may have serious risks, such as altered mood (anxiety, apathy, paranoia, psychosis); altered behavior (impaired coordination); sleep disorders, addiction, altered breathing and heart rate; communication of infectious disease; distorted senses; unconsciousness leading to coma; and permanent damage to the liver, heart and central nervous system leading to death. Assistance Programs
The College recognizes that alcohol and drug abuse and addiction are treatable illnesses. We also realize that early intervention and support improve the success of rehabilitation. To support our employees and students, our drug-free policy:
- Encourages employees and students to utilize the services of qualified professionals in the community to assess the seriousness of suspected drug or alcohol problems and identify appropriate sources of help.
- Allows employees the use of eligible accrued leave while seeking treatment for alcohol and other drug problems.
Treatment for alcoholism and/or other drug use disorders may be covered under employee and student health plans. However, the ultimate financial responsibility for recommended treatment belongs to the employee or student. (See for more information.)

Confidentiality
All information received by the College through the drug-free program is confidential communication. Access to this information is limited to those who have a legitimate need to know in compliance with relevant laws and College policies.

Attendance/Employment Conditions/Disciplinary Sanctions
Students, employees, and visitors must abide by the terms of this policy or be subject to disciplinary action up to and including expulsion or termination of employment as may be provided in the procedure or the procedure.
- Students receiving performance awards or athletic scholarships may be subject to random drug screening and/or testing in order to assure compliance with these Acts and College policy.
- The College reserves the right to test employees for a controlled substance or abuse of alcohol with reasonable suspicion of cause to assure compliance with these Acts and College policy.
- Employees must notify the College of any criminal drug statute conviction for a violation occurring in the workplace no later than five (5) days after such conviction. Such notice shall be provided in writing by the employee to the Director of Human Resources.
- Sanctions will be imposed against students, employees, or visitors found to be in violation of this policy. (See for more information.)
College Requirements
- When appropriate, notify any granting agency within ten (10) days of receiving notice of any employee criminal drug statute conviction.
- Take appropriate personnel action within 30 days of receiving notice of a violation of College policy or criminal drug statute conviction, including but not limited to;
- Referral for prosecution and employment termination.
- Referral of employee to a Counseling/Rehabilitation Program;
- Require convicted employee to participate satisfactorily in drug abuse assistance or rehabilitation program approved for such purposes by a federal, state, or local health, law enforcement, or other appropriate agency.
- Make a good faith effort to continue to maintain a drug-free environment, including policy statement distribution and education.
- Maintain a procedure to provide and relevant to this policy and conduct a biennial review of this procedure.

The College provides Worker's Compensation Insurance for all employees as required by law. The College also purchases general liability insurance for incidents/accidents involving students and visitors.
In the event of an incident (an occurrence not resulting in immediate medical attention) or an accident requiring immediate medical attention involving students, employees, or visitors to College premises, an Incident/Accident Report Form should be completed within twenty-four (24) hours and returned to the appropriate College official as specified on the form. Incident/Accident Report Forms may be obtained through the College's Office of Human Resources, Health Services, Business Office, or Campus Safety.
The College shall have the right to conduct tests for drugs or alcohol on employees who are involved in an accident occurring during a time when the employee is working for the College.

The College prohibits dating, sexual or intimate relationships between employees who can exercise power or control over another employee, students and/or student employees, unless they are legally married. College employees who do not adhere to this policy are subject to disciplinary action up to and including termination.
Personal Relationships Guidelines
Employees who are aware of employee/employee or employee/student relationships that are in violation of this policy must notify Human Resources immediately.
Employee/Employee Relationships
Unless they are legally married, a dating, intimate, or sexual relationship between a college employee who can exercise power or control over the other employee is prohibited. People in positions of authority who abuse or appear to abuse their power cause severe damage to the college.
Employee/Student Relationships
Unless legally married, dating, intimate or sexual relationships between a student and any college employee who can exercise power or control over that student is prohibited. Many employees of the college exercise various types of control or power over students. This power can be in the form of praise, criticism, disciplinary action and evaluation, financial aid, playing time for athletes, recommendations for employment or further education, or bestowing any other benefit on them. Such relationships, even though apparently consensual, create inherent conflicts of interest, tend to be exploitive in nature, and call into question the judgment and professionalism of the college employee. These relationships greatly increase the chances that the employee in the position of power will abuse that power or appear to abuse it to exploit the student or favor that student, unfairly placing other students at a disadvantage.

Applicable Scope

In order to promote a safe and secure campus and learning environment, 91勛圖厙 prohibits the possession or use of Weapons(1) on Campus and at Off-Campus Activities, other than as set forth below.
Concealed Carry
In accordance with the Kansas Personal and Family Protection Act, K.S.A 75-7c01, and other applicable federal/state laws, it is permissible and will not be a violation of the Policy for the:
泭泭泭 I. carrying of a concealed Handgun(2)泭on Campus by legally qualified individuals, pursuant to Kansas泭Law, and also in accordance with the Concealed Carry Restrictions set forth below,泭泭泭泭 II. lawful carrying of a concealed Handgun by an employee performing College duties at an off-campus activity, when in accordance with applicable laws/polices for such location,
泭泭 III. lawful possession of a Handgun within a personal/non-College vehicle,
泭泭 IV. lawful possession of Weapons:
泭泭泭泭泭泭泭泭泭泭 a. by law enforcement officers while acting within the scope of the employment
泭泭泭泭泭泭泭泭泭泭 b. by military personnel who must carry a firearm as a part of their commission
泭泭泭泭泭泭泭泭泭泭 c. as necessary for the conduct of College approved programs and activities.
泭泭泭泭泭泭泭泭泭泭 d. by college employees that have been issued handguns as part of their job duties.
Open Carry Prohibited:
Except as otherwise specifically provided in the Policy Statement above, open carry of any firearm anywhere on 91勛圖厙s Campus is prohibited. Each entrance to each building shall be conspicuously posted with appropriate signs indicating that openly carrying a firearm into that building is prohibited.
Concealed Carry Restrictions:
Concealed Carry:泭 Each individual who lawfully possesses a Handgun on Campus shall be wholly and solely responsible for carrying, storing, and using that Handgun in a safe manner and in accordance with the law and this Policy.泭 Individuals who carry a Handgun on Campus must carry it concealed on or about their person at all times.泭 Concealed means completely hidden from view and does not reveal the Handgun in any way, shape, or form.泭 About the person means that and individual may carry a Handgun if it can be carried securely in a suitable carrier, such as a backpack, purse, handbag, or other personal carrier designed and intended for the carrying of an individuals personal items.泭 The Carrier must at all times remain within the exclusive and uninterrupted control of the individual.泭 This includes wearing the carrier with one or more straps, consistent with the carriers design, carrying or holding the carrier, or setting the carrier next to or within the immediate reach and control of the individual.泭 Except in those instances where necessary for self-defense or transferring to safe storage and except as otherwise provided in this policy, it shall be a violation of this policy to openly display any handgun while on campus.
Restriction Pursuant to Kansas Law:泭泭 Kansas Law states that the only type of firearm that an individual can carry while concealed is a Handgun as defined above.泭 The following restrictions applicable to all firearms specifically apply to the concealed carrying of a Handgun under Kansas law and this Policy, and the violation of any of the following restrictions is a crime under Kansas law and a violation of this Policy:
泭泭泭 An individual in possession of a concealed firearm must泭
泭 泭 泭 泭 泭 泭o be at least 21 years of age [K.S.A. 21-6302(a)(4)]; or
泭 泭 泭 泭 泭 泭o possess a valid provisional license issued pursuant to K.S.A. 75-7c03, and amendments thereto; or
泭 泭 泭 泭 泭 泭o possess a valid license or permit to carry a concealed firearm that was issued by another jurisdiction and is recognized in this state pursuant to K.S.A. 75-7c03.泭泭
泭泭泭 A firearm cannot be carried by an individual:
泭泭泭泭泭泭泭泭泭泭 o under the influence of alcohol or drugs to a degree as to render the individual unable to safely泭

泭泭泭泭泭 less than 60% lead by weight is illegal [K.S.A. 21-6301 (a)(6)];
泭泭泭 Suppressors and silencers cannot be used with a firearm [K.S.A. 21-6301 (a)(4)]; and
泭泭泭 Criminal discharge of a firearm is reckless and unauthorized discharge of any firearm at any person,泭
泭泭泭泭泭泭 or at a dwelling, or at a structure or vehicle, except in self-defense [K.S.A. 21-6308, 6308a];
Location Restrictions:泭Certain Campus buildings and/or Public Areas(3)泭 within the Campus may be permanently or temporarily designated to prohibit concealed Handguns with the installation or use of Adequate Security Measures.泭 Appropriate notification will be given and posted in the event that an area of the campus has been designated to permanently or temporarily prohibit concealed Handguns.
Facilities which are leased/occupied by 91勛圖厙 fall under this policy unless the facility owner has lawfully excluded or permit Handguns from their facility.泭 Facilities such as Federal military installations, correctional facilities, etc. may have policies and procedures exclusive to those facilities.泭 Individuals are expected to comply with the policies imposed by the location.泭 The possession/transportation of a handgun in college owned vehicles is prohibited (with exception to Concealed Carry section IV).
Safety Requirements:泭To reduce the risk of accidental discharge on Campus, when carrying a concealed Handgun on Campus (whether on the person or in a carrier), the concealed Handgun is to be secured in a holster that completely covers the trigger and the entire trigger guard area and that secures an external hammer in an un-cocked position through the use of a strap or by other means.泭 The holster is to have sufficient tension or grip on the handgun to retain it in the holster even when subjected to unexpected jostling.泭 Handguns with an external safety are to be carried with the safety in the on position.泭 Semiautomatic handguns are to be carried without a chambered round of ammunition and revolvers with a hammer resting on an empty cylinder.
Storage:泭 Handgun storage is not provided by 91勛圖厙.泭 Handguns that are not in the individuals exclusive and uninterrupted control may store a Handgun in:
泭 泭 The individuals vehicle when the vehicle is locked and the Handgun is secured in a location within泭
泭泭泭泭泭泭 the vehicle that is not visible from outside the vehicle.
泭泭泭 A dorm room or office in a secure, locked, storage device that conceals the gun from view.泭 Such泭泭泭泭
泭泭泭泭泭 storage devices shall be provided by the individual who possesses the handgun and must meet泭
泭泭泭泭泭 minimum industry standards for safe-keeping of handguns.泭 These storage devices must be secured泭
泭泭泭泭泭 to a fixed object in the room with a cable locking device.
Specifically, it is prohibited for any individual to store a Handgun:
泭 泭 in a vehicle that is unlocked or when the Handgun is visible from outside the vehicle,
泭泭泭 in a college owned vehicle,
泭泭泭 in an individuals assigned office or dorm room when not locked in a secured storage device泭
泭泭泭泭泭 (meeting minimum industry standards for safe-keeping of handguns),
泭泭泭 in a classroom or any other campus facility,
泭泭泭 in an unattended backpack/carrier,
泭泭泭 in any type of locker, desk, closet, etc. not intended for handgun storage or,
泭泭泭 in any other location and under any circumstances except as specifically permitted by this policy泭
泭泭泭泭泭 and by state and federal law.
Training:
Individuals are encouraged to obtain training in the proper handling of concealed Handguns.泭 Concealed carry classes are available locally.泭 The lawful carrying of a concealed Handgun has its own risks.
Violation of Policy:
Any person violating this policy may be subject to appropriate disciplinary action, including but not limited to suspension, termination, expulsion, immediate removal from the campus, and/or campus housing, and/or arrest. This includes the accidental or unintended discharge of a firearm in violation of K.S.A. 21-6308.
Notice:
Any report of Weapons being openly displayed on 91勛圖厙s campus will be responded to by the Campus Safety Department and the 91勛圖厙 County Sheriffs office.泭 The lawful carrying of a concealed Handgun should not create concerns on campus; however, anything other than the lawful carrying of a concealed Handgun has the potential to create confusion and additional risks and will be responded to by Campus Safety and the 91勛圖厙 County Sheriffs office.
It is the responsibility of the individual choosing to Concealed carry to be aware of both Federal and individual state laws regarding the concealed carry of weapons into other jurisdictions that they may travel to.泭 There are significant differences in laws between Kansas and other jurisdictions.
Reporting:
Individuals should report violations of this Policy to the Campus Safety Department

(1) Weapon means weapon described in K.S.A. 21-6301, as further defined under K.S.A. 75-7c20; however, for purposes of this Policy, includes knives more than 4 inches in length.

(2) Handgun is defined as a firearm. Pursuant to K.S.A. 75-7c02, with cross-reference to K.S.A. 75-7b01.泭 Specifically, under K.S.A 75-7b01, it is: (1) a pistol or revolver which is designed to be fired by the use of a single hand and which is designed to fire or capable of firing fixed cartridge ammunition; or (2) any other weapon which will or is designed to expel a projectile by the action of an explosive and which is designed to be fired by the use of a single hand.
(3)Public Areas is defined at K.S.A. 75-7c20
The Board of Trustees, administrators, faculty, and staff at 91勛圖厙 recognize a shared responsibility to protect the integrity of the institution and to conduct business according to the highest legal and ethical standards. Therefore, it is the responsibility of the President to ensure that the College, its Board members, and employees adhere to standards and principles that are legal, ethical, and morally correct and avoid actual, potential, or perceived conflicts of interest.

It is the intent of 91勛圖厙 County Community College to support academic freedom while complying with all applicable泭泭laws (U.S. Copyright Law of 1976) and provisions thereof, including those pertaining to泭,泭泭(Technology, Education and Copyright Harmonization) Act, and the泭(Digital Millennium Copyright Act).
91勛圖厙 County Community College will comply with the requirements of the TEACH Act by the following:

泭泭泭泭泭泭泭泭泭泭泭泭 2. 91勛圖厙 County Community College has a copyright policy for students, educators, and staff in泭place.
泭泭泭泭泭泭泭泭泭泭泭泭 3. The college will provide informational materials regarding copyright law.
泭泭泭泭泭泭泭泭泭泭泭泭 4. Notice to students about copyright implications of course materials will be provided泭electronically (course shell) and/or print (on materials distributed in class).
泭泭泭泭泭泭泭泭泭泭泭泭 5. Content is to be available to enrolled students for that specific course.
91勛圖厙 employees may temporarily copy or digitize legally acquired materials for face-to-face- or online instruction as long as the material is not otherwise available for purchase or licensing as a multi-user as instructional tool such as a textbook, workbook, electronic module, software or course packet.
91勛圖厙 students meeting the threshold of 91勛圖厙s Copyright Law Policy are reminded they still need to adhere to 91勛圖厙s Academic Integrity Policy and Procedure for attribution of materials through citation. Violation of U.S. Copyright Law is defined as a criminal offense (See #10) in procedure泭.

91勛圖厙 provides for a comprehensive learning environment and is committed to the success of each student. Essential to our commitment is the safety and security of our students, employees, guests, and visitors.
It shall be the responsibility of the Campus Safety Department to help preserve the peace, prevent crimes, detect and report violators, protect life and property, and to see that the laws of the State of Kansas, and the safety policies and procedures of 91勛圖厙 are enforced on the 91勛圖厙 County campus.
Any student, employee, guest, or visitor who witnesses a crime, or identifies a potential hazardous situation is encouraged to contact the Campus Safety Department at 620-792-9217 or File a Report.
